Liability and Insurance Coverage Policy

At Jomietasker, we are committed to providing high-quality cleaning services backed by an insurance policy that covers material damages, verifiable losses, and other unforeseen incidents that may arise during the provision of our services. To ensure the effectiveness of this coverage and to protect the interests of both our clients and our company, the following conditions, exclusions, and procedures are established.

 

1. Declaration and Verification of Valuable Items or Cash

  • Prior Notification of Valuable Items:

    • Clients must notify in writing any valuable items or cash exceeding $1,000 USD present at the service location.
    • This notification must be submitted at least 24 hours prior to the service start time, specifying the location and estimated value of the declared items or cash.
  • Verification Procedure:

    • Before starting the service, the Jomietasker team will verify the existence of the declared items or cash in the client’s presence.
    • A detailed record will be prepared, including:
      • A precise description of the item or declared amount.
      • The estimated value provided by the client.
      • Photographs of the condition and location of the items.
      • Signatures from both the client and the Jomietasker representative as proof of verification.
  • Limitations:

    • Jomietasker will not assume custody or direct responsibility for the declared items or cash; verification is solely for recording purposes.
    • Failure to notify and verify in advance releases Jomietasker from any liability for losses or damages related to such items or cash.

 

2. Client Responsibilities

To ensure the safety and effectiveness of the service, clients are required to:

  • Indicate Restricted Items:

    • The client must explicitly inform Jomietasker’s workers before the service begins which items or areas:
      • Should not be cleaned.
      • Should not be touched, moved, or manipulated in any way.
  • Failure to Notify Restricted Items:

    • If the client does not clearly communicate this information to the workers, Jomietasker will be exempt from all liability for any claims or damages related to such items or areas.

 

3. Reporting Damages or Losses

  • Reporting Deadline:

    • Any damage or loss must be reported in writing within 24 hours of service completion.
  • Reporting Process:

    • The client must send an email to sales@jomietasker.com or use the contact form on our website, providing:
      • A detailed description of the incident.
      • Photographic evidence of the item’s condition before and after the service.
      • The original purchase receipt or documentation proving ownership and value of the item.

 

4. Claim Evaluation

  • Authorization for Investigation:

    • By submitting a claim, the client expressly authorizes Jomietasker to:
      • Access the property where the incident occurred to collect additional evidence.
      • Conduct thorough inspections, interviews, and any necessary procedures to determine the causes of the damage or loss.
      • Document findings through photographs, videos, or written reports.
  • Investigation Impediments:

    • If the client prevents, obstructs, or does not authorize Jomietasker to carry out the necessary investigation, Jomietasker will be automatically exempt from all responsibility related to the claim.
    • This exemption includes any obligation to make payments under the applicable insurance policy, as the lack of cooperation from the client makes it impossible to determine the causes and responsibilities.
  • Investigation Results:

    • Once the investigation is complete, Jomietasker will provide a final report to the client with conclusions and, if applicable, steps to proceed with compensation.

 

5. Coverage Exclusions

Jomietasker shall not be responsible for activating the insurance policy or assuming liability for damages or losses in the following circumstances. Failure to comply with any of the conditions below automatically releases Jomietasker from all payment obligations:

  • Failure to Notify or Verify:

    • Valuable items or cash that were not declared and verified according to the established procedure.
  • Lack of Evidence:

    • Claims that lack proper documentation, including:
      • Clear and verifiable photographs of the item’s condition before and after the service.
      • Purchase receipts or documents proving ownership and value of the item.
  • Pre-existing Damages:

    • Damages, defects, or wear that existed prior to the service being performed.
  • Intentional Acts or Gross Negligence:

    • Damages caused by:
      • Deliberate actions by the client or third parties unrelated to Jomietasker.
      • Gross negligence by the client or any individual not affiliated with Jomietasker.
  • Failure to Indicate Restricted Items:

    • Damages or issues caused by the cleaning, movement, or manipulation of items or areas not explicitly identified by the client as restricted before the service.
  • Force Majeure:

    • Losses or damages resulting from events beyond Jomietasker‘s control, such as:
      • Natural disasters (hurricanes, tornadoes, floods, earthquakes, etc.).
      • Civil disturbances, terrorism, or any other unforeseeable events.
  • Fraudulent Claims:

    • Claims found to be fraudulent or misleading, including:
      • Falsification or manipulation of evidence.
      • Malicious or inaccurate declarations by the client.

 

Important Note:
Failure to comply with any of the conditions listed above will release Jomietasker from the obligation to respond to the client for claimed damages or losses, including compensation under the applicable insurance policy.

 

6. Compensation Process

  • Determination of Value:

    • In cases of validated damage or loss, compensation will be based on:
      • The current market value of the item, considering depreciation for use and age.
      • The maximum amount covered under the applicable insurance policy.
  • Liability Limitations:

    • Jomietasker’s liability is limited to the verified value of the damage or loss and will not exceed the maximum limit set forth in the insurance policy.

 

7. Legal and Regulatory Compliance

  • Adherence to Applicable Laws:

    • This policy complies with the laws and regulations applicable in the state of North Carolina and the United States, including but not limited to:
      • Civil and commercial liability regulations.
      • Consumer protection regulations.
      • Applicable insurance and contract laws.
  • Policy Updates:

    • Jomietasker reserves the right to modify this policy to ensure ongoing compliance with legislative or regulatory changes.

 

8. Acceptance and Agreement

  • Client Consent:
    • By hiring Jomietasker‘s services, the client acknowledges having read, understood, and agreed to the terms of this policy.
